Terms and Conditions 1. Use of the Course and Fees 1.1 The Course is operated by the ACMHN. To use the Course, You must have paid the fees for the Course, as published by ACMHN. 1.2 To register you must be over 18 years of age. 2. ID Number 2.1 You may only access the Course by entering Your ID Number at the Course log in page. You agree that You will not disclose, or permit disclosure of, Your ID Number to anyone. You will be fully responsible for all acts and omissions of any person who accesses or uses the Course using Your ID Number, as if they were Your own acts and omissions. ACMHN will not in any event be liable for any loss, damage, claims, costs or expenses arising out of the use or misuse of Your ID Number or the Course. 3. Term 3.1 These Terms are effective from the date on which ACMHN receives Your correctly completed registration form and the fees. 4. Cancellations and Refunds 4.1 You may cancel Your access to the Course within 7 days of registration provided that You have not commenced accessing the Course materials. After this, no refund will be given. 4.2 Cancellations must be made in writing via email to enquiries@acmhn.org. Please allow at least 14 days for Your refund to be processed after it has been approved. 4.3 Once You have commenced the Course You may not transfer it to a third party. 5. Termination 5.1 ACMHN will terminate your access to the Course immediately if it is found that You have disclosed Your ID Number to another person, or provided another person with access to the Course. 5.2 No refund will be provided to You in the event of termination in accordance with Term 5.1 above and access to other ACMHN online activities may be denied. 6. Timeframe to complete the Course 6.1 You must complete the Course within 3 months of ACMHN providing You with access to the Course. 6.2 After 3 months, Your log in will expire and You will no longer be able to access the Course materials. 6.3 You may apply to ACMHN in writing for an extension of the time to complete the Course via email to enquires@acmhn.org. ACMHN may grant an extension at its discretion and is under no obligation to do so. Any request must be received at least 14 days prior to expiry. 7. Assessment 7.1 You agree that ACHMN’s decision on the mark of an assessment is final. 8. Disclaimer 8.1 While the Course was funded by the Commonwealth Department of Health and Ageing, the Course is provided by ACMHN. The Commonwealth of Australia does not warrant or represent that the information contained in this Course is necessarily clinically adequate or appropriate. The Commonwealth of Australia does not accept any legal liability or responsibility for any injury, loss or damage incurred by the use of, or reliance on, or interpretation of, the information contained in the Course. 8.2 The Course is a familiarization program Course only and does not provide You with any accreditation to undertake the work referred to in the Course. While the ACMHN has made every effort to provide up to date information in the Course, it is highly recommended that You seek formal training on the subject matter of the Course. The Course is subject to change at any time without notice. ACMHN takes no responsibility for any error, omission or defect within the Course and under no circumstances is ACMHN, or any of its employees or agents to be taken to be giving advice. To the full extent permitted by law, ACMHN does not accept any legal liability or responsibility for any injury, loss or damage incurred by the use of, or reliance on, or interpretation of the information contained in the Course. 9. ACMHN Website 9.1 Although reasonable efforts are made by ACMHN to ensure the integrity of its website by using virus-checking software, ACMHN cannot guarantee the safety of computer systems of site users. ACMHN does not accept liability for any loss or corruption of electronically stored data or any damage to any computer system sustained in connection with the use of its website. You acknowledge that you enter and use the ACMHN Website at Your own risk. 9.2 The ACMHN does not warrant or represent that the ACMHN Website will be free of defects in operation or design. 10. Third Party Sites 10.1 The Course and ACMHN’s Website contains links to third party sites. ACMHN is not responsible for the condition or content of those websites as they are not under ACMHN’s control. The link(s) are provided solely for your convenience and do not indicate, expressly or impliedly, any endorsement or recommendation of the material on the sites or of any third party products or services offered by, from or through those sites. It is Your responsibility to make Your own decisions about the accuracy, currency, reliability and correctness of information contained in linked external websites. 11. Intellectual Property and Permitted Use 11.1 Intellectual property in ACHMN’s Website, the content, the services and all components of them is owned by or licensed to ACMHN unless otherwise indicated. 11.2 All copying, downloading, reproduction, distribution, adaptation, modification or communication of any content is prohibited unless otherwise authorised. 12. Indemnity 12.1 You acknowledge that a breach of these Terms may infringe not only the rights of ACMHN, but also the rights of third parties whose intellectual property is licensed to ACMHN. Without limiting any other provision of these Terms, You agree to fully indemnify ACMHN in respect of all claims, demands and proceedings brought by You or third parties (including all legal fees) arising out of Your breach of these Terms and Your use of the Course and ACHMN’s Website. 13. Privacy 13.1 You agree for ACMHN to collect Your personal information for the purposes of this Course and for ACMHN to provide and use Your personal information, which will be de-identified, for the purposes of creating demographic and use reports which may be provided to third parties. 13.2 ACMHN will keep any personal information, except as detailed in Term 12.1 above (including your account details) confidential. ACMHN will ensure any such personal information that ACMHN has about You secure and to ensure that any of our employees or agents who have access to the personal information about You do not make any unauthorized use, modification, reproduction or disclosure of that personal information. 13.3 You can gain access to Your personal information by contacting the Chief Executive Officer via email at executive@achmhn.org and also correct your personal information if it is inaccurate, incomplete or out-of-date. 13.4 ACMHN will only disclose personal information that we have about You: (a) to the extent permitted by law; or (b) for the purposes of this Course (including disclosing information in connection with any query or claim). 14. Jurisdiction 14.1 These Terms are governed by and must be construed in accordance with the laws of Australian Capital Territory. The parties submit to the exclusive jurisdiction of the courts of that Territory and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms, their performance and subject matter.
